1. SCOPE OF THESE TERMS

 

1.1 These terms apply to every visit to elvxqira.com and to every order placed with us, whether through our website, by email, or by phone. Any separate agreement only applies if we have confirmed it with you in writing.

 

1.2 These terms are written for consumers, meaning private individuals placing an order for personal use rather than for a business or trade purpose.

 

2. ABOUT ELVXQIRA

 

2.1 Elvxqira is an online store selling women's summer dresses.

 

2.2 We may update or adjust features of our website and service from time to time, and may limit certain functionality when necessary.

 

2.3 We may update these terms at any time. The version in effect at the moment you place an order is the one that applies to that order, unless a legal requirement forces an earlier change to apply retroactively.

 

3. PLACING AN ORDER

 

3.1 An order is submitted when you complete checkout and confirm your purchase. This is treated as your offer to buy, and it remains valid for a reasonable period while we process it.

 

3.2 We reserve the right to decline or cancel an order, for example in cases of stock errors, pricing errors, or suspected fraud. If this happens, we will let you know and refund any payment already made.

 

3.3 An automatic order confirmation email only confirms that we received your order. The contract between us is only finalized once we send a shipping confirmation or otherwise confirm acceptance of your order.

 

4. PRICES AND PAYMENT

 

4.1 All prices shown at checkout are final and include applicable VAT. No hidden fees are added at a later stage.

 

4.2 Accepted payment methods are shown at checkout. We reserve the right to offer or withdraw specific payment methods at any time.

 

4.3 Your payment details are transmitted securely and are not stored on our own servers beyond what is needed to process your order.

 

5. SHIPPING AND DELIVERY

 

5.1 We currently ship only to addresses within the Netherlands. Orders are dispatched from our partner facilities in Germany or France.

 

5.2 We offer two shipping options at checkout:

 

Standard shipping (free): Delivery typically takes 4 to 5 business days from the day your order is dispatched.

 

Express shipping (4.95 euro): This option is insured and typically takes 2 to 3 business days from the day your order is dispatched.

 

5.3 Delivery times are estimates and start counting from the business day after your order is confirmed and dispatched, not from the moment the order is placed. Occasional delays can occur due to circumstances outside our control, such as customs checks or courier disruptions.

 

5.4 Because our express option is insured, any loss or damage occurring in transit under that option is covered. If you selected standard shipping and your parcel is lost or arrives damaged, please contact us at info@elvxqira.com so we can look into it and find a fair solution.

 

6. RIGHT OF WITHDRAWAL AND RETURNS

 

6.1 As a consumer shopping online within the EU, you generally have the right to cancel your order within 14 days of receiving it, without giving a reason.

 

6.2 To return an item, please contact us first at info@elvxqira.com so we can guide you through the process. Items should be returned unworn, unwashed, and with original tags attached wherever possible.

 

6.3 Once we receive and inspect your return, we will process your refund to the original payment method within a reasonable time, and no later than required by law.

 

6.4 Return shipping costs are the customer's responsibility unless the item was faulty, incorrect, or damaged on arrival.

 

7. OWNERSHIP OF GOODS

 

Items remain the property of Elvxqira until payment has been received in full.

 

8. WARRANTY AND LIABILITY

 

8.1 We stand behind the quality of the items we sell and will address genuine defects in line with applicable consumer protection law.

 

8.2 Our liability is limited to what is legally required. We are not liable for indirect or consequential losses, except where liability cannot be limited by law, such as in cases involving personal injury caused by our negligence.

 

9. DATA PROTECTION

 

We handle personal data in line with applicable Dutch and EU privacy law, including the GDPR. For details on what we collect and how it is used, please see our Privacy Policy.

 

10. PROMOTIONS AND DISCOUNT CODES

 

From time to time we may offer discount codes or promotions. Each promotion has its own terms, communicated at the time it is offered. Discount codes cannot be combined, have no cash value, and cannot be applied retroactively to past orders.

 

11. GOVERNING LAW AND DISPUTES

 

11.1 These terms are governed by Dutch law.

 

11.2 If a dispute cannot be resolved directly with us, EU consumers can also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

 

12. GENERAL

 

If any part of these terms is found to be invalid or unenforceable, the rest of the terms remain in full effect, and the invalid part will be replaced by a provision that reflects its original intent as closely as possible under the law.
